Beach Access

The developer of Marshview’s 58 townhomes secured an easement to give Marshview's owners and tenants access to the beach.  The easement runs along the south property line at 4430 Coastal Highway.  

While this access was closed after Hurricane Matthew in 2016, it has since been opened to Marshview residents.  There is a gate heading down to the beach.  

Please note that the gate code for the beach access is 123124.

This code is provided for the exclusive use of our residents and should be kept confidential. For security reasons, we ask that you do not share this code with non-residents under any circumstances.

Use, Care and Limitations of Beach Access Walkover

Rules and Regulations

  1. Only those individuals named in the Easement Agreement (attached as Exhibit A) are granted exclusive rights to use the 5’ rights of access located on the South boundary of Lot 1 on which a wood walkover structure has been constructed.
  2. No other person, other than those specifically named in the Easement Agreement, is entitled to the use of the beach access.  All those who are granted access rights must act in accordance with the terms of the Agreement.
  3. Ingress and egress to and from the beach is only allowed on the wood walkover structure.  No other paths or walkways are permitted to be used.
  4. All motorized vehicles are prohibited from using the easement as a way to gain ingress to the beach or egress from the beach.  Non motor-powered bicycles are permitted to be taken over the walkover.
  5. Parking across the street in front of and adjacent to Lot 1 is strictly prohibited. Temporary parking to load or unload beach supplies and equipment is prohibited.
  6. The access to beach is for the sole purpose of providing ingress and egress to the beach.  The walkover easement may not be used for the gathering of people or any other stationary activities.
  7. No activities will be tolerated that may cause a disturbance to the owners adjacent to the north or south of the access.
  8. At no time will any fireworks or open fires be permitted on any part of the access.
  9. The beach access walkover is to remain free of impediments at all times.  No beach balls, surf or boogie boards, bicycles or any other object is allowed to be left for any period on any part of the access.
  10. Any individual who violates these rules and regulations will be in jeopardy of losing their individual rights to the beach access.  Any willful action to cause damage to the walkover structure or to any of the natural vegetation will be held financially responsible for all repairs and will immediately loose the access rights to the beach easement.  Flagrant violation of the rules and terms of the easement agreement will result in the loss of privileges to use the easement.
  11. The Board of Directors of Marsh View at Ponte Vedra Shores West Homeowner’s Association has the responsibility to enforce the terms of the Easement Agreement and the Rules and Regulations.  The loss of privileges to use the beach easement due to violations of these Rules and Regulations and/or the terms of the Easement Agreement will be decided on by a majority vote of the Board of Directors.  Individuals who lose their privileges will be informed in writing. 
  12. Individuals who lose their privileges to the beach access have the right to appeal to the Board’s decision by writing to the Board and requesting an audience with the Board to represent themselves and present their case for reversal of the decision.  An appeal decision by the Board will be final and binding.
